By accessing or using PermitProwler ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

PermitProwler provides automated monitoring of commercial building permit data from public city APIs in Nashville, TN and Raleigh, NC. The Service delivers alerts via SMS and email when permits match subscriber-defined criteria.

3.1 Eligibility: You must be 18 years or older and authorized to enter into binding contracts.
3.2 Account Accuracy: You must provide accurate company information, contact details, and service area preferences.
3.3 Prohibited Uses: You may not:

• Resell or redistribute permit data to third parties

• Use automated scripts to scrape the dashboard

• Share your account credentials with others

• Use the Service for illegal purposes

• Misrepresent your qualifications in introduction emails

4. Data Accuracy & Limitations

4.1 Data Source: Permit data is sourced from official city APIs (Nashville Socrata and Raleigh Open Data). We display data as provided by these sources.
4.2 No Guarantee: We make no guarantee regarding:

• Completeness of permit data (cities may have delays or omissions)

• Accuracy of General Contractor contact information

• Availability of city APIs (subject to municipal maintenance/outages)

• SmartScore accuracy (it is a heuristic ranking, not a probability)

4.3 SmartScore Disclaimer: SmartScore™ is a proprietary priority ranking system designed to help users focus on opportunities most aligned with their business profile. It is NOT a probability of winning, a guarantee of project outcome, or a representation of actual bid success likelihood. Actual bid outcomes depend on pricing, capabilities, relationships, competitive factors, and variables beyond our scoring model.

5. Introduction Email Feature

5.1 User Consent Required: By using the one-click introduction generator, you grant PermitProwler permission to send emails on your behalf to General Contractors.

5.2 No Pricing Commitments: Introduction emails generated by the Service explicitly state that no pricing is being offered or implied. Users are responsible for providing pricing only after reviewing full bid documents.

5.3 User Responsibility: You are responsible for the content of introduction emails sent on your behalf, including accuracy of stated qualifications and licensing status.

5.4 Indemnification: You agree to indemnify PermitProwler from any claims arising from introduction emails sent on your behalf, including but not limited to claims of misrepresentation or unauthorized contact.

6. Subscription & Payment

6.1 Billing: Subscriptions are billed monthly in advance via Stripe. By subscribing, you authorize recurring charges.

6.2 Price Changes: We reserve the right to change pricing with 30 days notice to active subscribers.

6.3 Failed Payments: If payment fails, your account will be suspended after 7 days. Reactivation requires payment of outstanding balance.

6.4 Cancellation: You may cancel at any time. Cancellation is effective at the end of the current billing period. No partial refunds for mid-month cancellations (except within 30-day satisfaction guarantee).

7. SMS Terms & Compliance

7.1 Consent: By providing your phone number, you consent to receive SMS alerts from PermitProwler.

7.2 Message Frequency: Message frequency varies based on permit activity in your service area. Typical range: 5-20 messages per week.

7.3 Opt-Out: Reply STOP to any SMS to unsubscribe from text alerts. You will continue to receive email alerts.

7.4 Carrier Rates: Message and data rates may apply. PermitProwler is not responsible for charges from your mobile carrier.

7.5 TCPA Compliance: We comply with the Telephone Consumer Protection Act. We will not send SMS to numbers on the Do Not Call Registry unless you explicitly consent.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

PermitProwler is provided "AS IS" without warranties of any kind, express or implied. We are not liable for:

• Lost bidding opportunities due to delayed, missing, or inaccurate alerts

• Incorrect GC contact information leading to failed outreach

• City API outages or data errors beyond our control

• Damages arising from use of the introduction email feature

• Lost profits, revenue, or business opportunities

Maximum Liability: Our total liability shall not exceed the amount you paid in the 3 months prior to the claim.

PermitProwler, SmartScore™, and all related marks are trademarks of PermitProwler. The Service's design, code, and algorithms are proprietary and protected by copyright.

10. Modifications to Terms

We may modify these Terms at any time. Material changes will be communicated via email 30 days in advance. Continued use after changes constitutes acceptance.

11. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or use the Service fraudulently.

12. Governing Law

These Terms are governed by the laws of Tennessee, USA. Disputes will be resolved in Davidson County, Tennessee courts.
